Failure to Report Alleged Abuse and Injury of Unknown Origin
Summary
The facility failed to ensure that an alleged abuse/injury of unknown origin involving a resident was reported immediately to the State Agency and law enforcement. The resident had multiple psychiatric and cognitive diagnoses, including vascular dementia, depressive disorders, PTSD, delusional disorder, anxiety disorder, hypertension, and chronic kidney disease. His quarterly MDS reflected a BIMS score of 12, indicating moderate impairment. His care record also showed behaviors including agitation, hitting, biting, kicking, spitting, cussing, racial slurs, elopement, stealing, delusions, hallucinations, psychosis, aggression, and refusal of care. The resident’s record and interviews showed that he sustained bruising to both thumbs and a skin tear to the left arm, but the source of the injury was not clearly established at the time. The resident told surveyors that while he was asleep, a young male wearing glasses attempted to place a hospital gown on him, and when he refused, the individual bit him on the left arm and grabbed his thumbs. He was unable to identify the person by name and could not clearly describe him beyond being a young male wearing glasses. Family reported that they were not notified until about 12 hours later and that the voicemail they received was vague, only mentioning thumb pain and x-rays. Facility staff gave differing accounts of how the injury occurred. An LVN reported being told the resident had a skin tear and bruising and that x-rays were ordered. The DON stated she attempted to interview the resident, but he would not provide details, and she later heard that the resident had been combative during brief care and had swung at staff. The Administrator stated the conclusions about the injury were assumptions based on available information and that the facility believed the injury may have occurred during care when staff attempted to place a hospital gown on the resident. The Ombudsman stated the resident told her someone had bitten him and that the injury appeared consistent with a bite mark, but facility staff disputed that interpretation. The facility policy required alleged or suspected abuse, neglect, injuries of unknown origin, and suspicious injuries to be investigated and reported immediately to the state agency complaint hotline, but the facility did not report the allegation to the State Agency or law enforcement.
