Failure to Notify Ombudsman and Provide Required Transfer/Bed-Hold Notices
Summary
The facility failed to timely notify and accurately send the Notification of Proposed Transfer/Discharge to the Office of the State LTC Ombudsman and failed to provide written notice to a resident’s representative regarding the reason for transfer and bed-hold rights for multiple residents. The deficiency involved Residents 49, 98, 221, 222, and 223, based on interview, medical record review, and facility policy review. The facility’s policy stated that the Ombudsman’s name, address, and phone number were part of transfer/discharge requirements, that transfer/discharge documentation must be placed in the medical record, and that residents and/or representatives must receive written notice of bed-hold rights at admission and before transfer to a hospital or therapeutic leave. Resident 49 was readmitted to the facility and later transferred to an acute care hospital for abdominal CT scan and further evaluation related to abdominal distention with tenderness. The medical record included physician orders allowing transfer to the hospital, but the Notice of Proposed Transfer and Discharge forms dated for the transfer did not show they were sent to the Ombudsman, and there was no documentation that the Ombudsman was notified. During interview and concurrent record review, the ADON verified the notification was not sent. Resident 221 was admitted and later transferred to an acute care hospital for evaluation with a physician order that also included a seven-day bed hold if admitted, but the Notice of Proposed Transfer and Discharge did not show it was sent to the Ombudsman and no documentation showed the Ombudsman was notified. Resident 222 was readmitted and later discharged due to death; the record showed an order to release the body to a mortuary provider, but there was no documented evidence that the Ombudsman was notified of the death. Resident 223 was admitted and later discharged home AMA with a responsible party, but the record also lacked documentation that the Ombudsman was notified. For Resident 98, who had no capacity to understand and make decisions, the record showed a physician order to transfer to an acute care hospital with a seven-day bed hold if admitted, but there was no written notification to the resident’s representative about the reason for transfer and bed hold, and no documentation that the Ombudsman was notified. The DON and ADON verified these notifications were not completed as documented.
