Failure to Provide Required RN Coverage
Summary
The facility failed to provide the services of a Registered Nurse (RN) for at least eight consecutive hours a day, seven days a week, as required by its policy and procedure titled, Staffing, Sufficient and Competent Nursing. During interview and record review, the Staffing Schedule for 7/2026 showed no RN scheduled during the AM shift on 7/1/26, 7/7/26, and 7/8/26, and no RN scheduled during the PM shifts on Wednesdays, Thursdays, Fridays, and Saturdays for the month of July. The Director of Nursing stated the AM and PM shifts were 12-hour shifts and that RNs were required to do rounds each shift. The DON also stated RNs had a more advanced scope of practice than LVNs and were required to work eight consecutive hours a day, seven days a week for 60 beds or more. The facility’s Daily Census on 7/24/26 showed 62 residents, and the facility license dated 6/17/26 showed a licensed capacity of 101 beds. During interview, the Administrator stated the facility did not have enough RNs to cover at least eight consecutive hours a day, seven days a week, and that the facility had posted LVN and RN positions and was open to staffing RNs from registry agencies. The facility’s policy stated that a registered nurse provides services at least eight consecutive hours every 24 hours, seven days a week, and the RN charge nurse job description stated the charge nurse was responsible for providing effective, efficient, and comprehensive resident care for no more than 64 residents.
