Failure to Protect Residents From Abuse and Neglect
Summary
The facility failed to protect residents from abuse, neglect, and mistreatment by a CNA after multiple staff members independently reported a recurring pattern of rough handling, refusal to provide needed care, delayed responses to call lights, and disregard for resident dignity. The facility’s own investigation substantiated elder neglect and mistreatment by the CNA and identified that multiple residents became agitated, upset, fearful, or emotionally distressed when he provided care. Residents involved in the allegations included residents who were described as having cognitive impairment, contractures, and toileting needs, and one resident was largely nonverbal during the events described. During interviews, CNAs reported observing the CNA hold a resident down on a commode while the resident repeatedly pleaded to get up, refuse a resident’s request to wear a T-shirt, fail to cleanse a resident after a bowel movement, and ignore repeated requests for assistance. Another CNA reported hearing a resident repeatedly ask to use the bathroom while the CNA told the resident he was not taking her, and also reported that the CNA routinely ignored call lights. A separate CNA described the CNA forcefully pushing a resident’s contracted lower extremities onto a positioning wedge despite the resident screaming in pain and pleading for him to stop, while another CNA reported the CNA lifted a resident from a wheelchair and threw him onto a bed even though the resident required a mechanical sit-to-stand lift for safe transfers. Record review showed the facility did not complete comprehensive post-incident assessments after the abuse allegations were substantiated. The records did not show timely head-to-toe skin or injury assessments for the affected residents after the initial allegations, and the only later physical finding identified was new bruising on one resident’s upper outer arm. The facility also did not document psychosocial or trauma assessments, supportive interventions, care plan revisions, increased monitoring, or individualized measures to address the physical and emotional impact of the substantiated abuse. The CNA admitted failing to cleanse one resident after a bowel movement and attributed his conduct to stress and distraction, while the facility determined his actions represented a willful, patterned, and conscious course of conduct.
