Failure to Report Allegation of Neglect

Vernon Rehabilitation And Healthcare CenterVernon, Connecticut Survey Completed on 07-27-2026

Summary

The facility failed to ensure an allegation of neglect involving a resident with a right femur fracture and a right radius fracture was reported to the state survey agency. The resident’s admission assessment identified intact cognition, a functional range of motion deficit affecting an upper extremity, total assistance needs for toileting and bed mobility, an indwelling catheter, and bowel incontinence. Physician orders directed turning and repositioning every 2 hours, floating heels in bed as tolerated every shift, and assistance from one staff member for bed mobility, transfers, toileting, bathing, and dressing. The resident reported that during the first week after admission, a nurse aide was rude, yelled, and left the resident in a soiled brief for four hours. The resident also stated there were other occasions when the nurse aide spoke rudely or made the resident wait over an hour for incontinent care. The resident further stated that a nursing supervisor and the DNS were aware of the concerns. An email from the resident’s family member stated that the resident had requested help to be changed due to incontinence and that the nurse aide accused the resident of soiling himself/herself for attention and refused to change the resident. Facility documentation did not include an incident or accident report for the allegation, and social work notes did not identify what action or follow-up occurred in response to the mistreatment allegation. Interviews with facility leadership showed the initial concern was treated as a customer service issue based on the ADNS’s interview with the resident, and the DNS stated the allegation was not reported to the state survey agency. The facility policy identified alleged abuse as requiring reporting within specified time frames, including reporting to the Administrator, state survey agency, and adult protective services or police, but this was not done until after surveyor inquiry prompted a reportable event submission.
