The facility failed to ensure that the nature and terms of a binding arbitration agreement were explained to residents in a form and manner they could understand for 2 of 5 residents reviewed. The deficiency involved Resident 11 and Resident 5, both of whom signed arbitration agreements during the admission process, but later stated they did not understand what arbitration was and did not know the agreement was voluntary. Resident 11 was admitted with multiple respiratory complications, stroke, altered mental status, and dementia. The resident signed the arbitration agreement on 04/09/2026, but later stated they were unaware of what arbitration was, that family was not present for the paperwork, and that facility staff did not explain the form or that signing was voluntary. Staff E stated the arbitration agreement was reviewed last during admissions and not in great detail, and Staff H stated they did not read it verbatim and could not recall whether either resident understood what they were consenting to. The Administrator stated the form contained legal jargon and staff should have explained the nature and terms in a way residents could understand.
