Misappropriation of Resident Trust Funds by FBOM
Summary
The facility failed to protect residents from the wrongful use of their belongings or money when the former Business Office Manager (FBOM) withdrew resident trust funds for personal use. Record review and interviews showed unauthorized withdrawals from the accounts of 10 sampled residents, including residents who were their own responsible parties, residents with family financial guardians or FPOAs, and residents who were nonverbal or unable to manage their own finances. The sampled withdrawals included repeated cash advances and other charges labeled as personal needs, clothing, burial, dental premium, and care cost payments, with no written authorization or supporting documentation found in the residents’ personal spending logs for the sampled transactions. For Resident #1, the resident stated he/she normally withdrew only $50 per month and denied the larger withdrawals listed in the trust statement. Resident #2 said he/she withdrew no more than $20 at a time and denied the listed withdrawals. Resident #3’s guardian stated the resident lacked capacity to withdraw funds and that the family handled the money; the guardian also noted that a 2024 trust statement provided by the facility showed different, smaller withdrawal amounts than the facility’s own statement. Resident #4’s family member said he/she managed the finances, bought everything for the resident, and did not believe the resident withdrew the listed amounts. Resident #5’s family member stated the resident could not speak, walk, or move his/her arms and could not have withdrawn the listed funds. Resident #6 said he/she did not remember withdrawing $200. Resident #7’s family member said the resident was nonverbal, had the mentality of a child, and was not aware of money, and questioned why the facility would need larger amounts for clothing. Residents #8 and #9 had no personal spending logs in the record, and their FPOAs stated they were unaware of the withdrawals and did not make them. Resident #10 said he/she had not withdrawn funds in a couple of years and would only withdraw up to $20. An outside business office consultant reported that resident fund files were missing and that the FBOM said, "You are not going to find them." During interviews, the FBOM admitted taking money from resident trust accounts for personal use, said he/she added amounts to residents’ requested withdrawals, and acknowledged knowing it was against policy. The owner stated the FBOM admitted taking resident money, and the regional director of operations reported the matter was referred to police. The regional business office manager stated the FBOM had higher access in the resident funds system and could cash checks without higher-level approval.
