Summary

The facility failed to ensure a resident with dementia, traumatic brain injury, major depressive disorder, arthritis, atrial fibrillation, severely impaired cognition, and dependence on staff for transfers, mobility, dressing, and bed mobility was free from verbal abuse. The resident’s record showed she had a history of verbal behaviors, refusal of care, and screaming at others, and her care plan directed staff to use positive interactions, explain procedures before starting care, allow time for adjustment, and use a full body lift for transfers because of limited mobility and extensive arthritis. During an evening bath episode, the resident repeatedly yelled that she did not want a bath and stated her arm hurt. Witness statements documented that staff continued the bath process despite the resident’s distress. One CNA reportedly told the resident she only got two baths a week and was going to take a bath, while another staff member observed the resident yelling and later heard the CNA call the resident an expletive. The resident was transferred to the bathhouse and continued yelling during care. The witness statements further documented escalating verbal exchanges between the CNA and the resident in the bathhouse and during transfer back with the lift. The CNA made insulting comments about the resident’s body and hygiene, told her her mother was dead and that she was in a nursing home, and called her an expletive. The resident responded by yelling, grabbing the CNA’s hair, and telling the CNA to leave her alone and get out. A later observation showed the resident calm with another CNA and unable to remember the incident, while administrative staff stated they were appalled by what the CNA had said to the resident.

After the resident was stable for return, the DON and administrator went to the hospital and, along with the owner and corporate administrator on speaker phone, were reported by the resident and hospital staff to have yelled, been rude and aggressive, and told the resident the facility would not take the resident back because of behaviors and money owed. The resident stated feeling pressured, outnumbered, and insignificant.
