Summary

The facility failed to keep two residents free from abuse when a physical altercation occurred between Resident #65 and Resident #124 in the hallway. According to the facility investigation, Resident #124 said something to Resident #65 as they passed each other, Resident #65 acted as if she was going to hit Resident #124, Resident #124 slapped Resident #65's arm away, and Resident #65 then hit Resident #124 in the back of the head with a closed fist. No injuries were noted, and the physician, on-call nurse, and both residents' families were notified. Resident #65 was admitted and readmitted with diagnoses including severe unspecified dementia, adult failure to thrive, alcohol abuse, anxiety disorder, depression, and insomnia. Her MDS showed short-term memory problems, severely impaired cognitive skills for daily decision making, fluctuating inattention and disorganized thinking, delusions, and wandering. Her care plan identified disruptive behavior, including going into other residents' rooms and rummaging through belongings, and noted she no longer had a sense of personal ownership. Facility documentation also described her as wandering into other residents' rooms and being difficult to redirect. Resident #124 was admitted and readmitted with diagnoses including Parkinson's disease, dysphagia, cognitive communication deficit, bipolar disorder, hearing loss, and PTSD. His MDS showed he was cognitively intact with a BIMS score of 14 out of 15, though he had fluctuating inattention and wandered one to three days during the assessment look-back period. His care plan identified episodic maladaptive behaviors in which he was physically aggressive toward other residents. During the incident, staff observed the exchange in the hallway and documented that Resident #124 slapped Resident #65's arm before Resident #65 struck him in the back of the head.

A resident with stroke-related diagnoses and cognitive intact status was transferred to the hospital for weakness, dizziness, pallor, and low K+. After the resident was stable for return, the DON and administrator went to the hospital and, along with the owner and corporate administrator on speaker phone, were reported by the resident and hospital staff to have yelled, been rude and aggressive, and told the resident the facility would not take the resident back because of behaviors and money owed. The resident stated feeling pressured, outnumbered, and insignificant.
