Failure to Provide Required RN Coverage
Summary
The facility failed to ensure the services of a Registered Nurse (RN) for at least 8 consecutive hours a day, 7 days a week. The census was 100 residents. Review of the Payroll-Based Journal (PBJ) Staffing Data Report showed the facility consistently triggered for a one-star staffing rating for all four quarters of 2025 and triggered no RN hours for quarters 1 and 2 of 2025. The report also identified dates with no RN hours submitted, including November 16 and 28, 2024; December 14 and 15, 2024; January 1, 4, and 5, 2025; and February 16, 2025. The facility assessment updated in November 2025 showed the facility was licensed for 119 residents, had an average daily census of 95 to 100 residents, and averaged 3 admissions per week and 1 discharge per week. The staffing plan listed licensed nurses providing direct care for 92.5 hours per day and other nursing personnel with administrative duties for 112 hours per week, but it did not distinguish RN hours from LPN hours. The assessment also stated that if nurses called off, responsibilities would be shifted, off-duty personnel would be contacted, a nurse manager might work the shift, or a contracted nursing agency would be contacted to fill the vacancy. Staff interviews and staffing records showed inconsistent RN coverage and documentation. Facility staff postings showed no RN hours on several dates in November 2024 and January 2025. Payroll review confirmed no RN worked on November 16, 2024, and no evidence was found that an RN worked on January 1, 4, and 5, 2025 or February 16, 2025. The Business Office Director stated the facility changed payroll systems and some time cards were lost, requiring manual entry. The DON stated the facility currently staffs one RN as charge nurse during the day Monday through Friday and uses the ADON for coverage, but also stated that no agency is used for RN services. The DON confirmed no RN worked on November 16, 2024 and stated that when no RN works 8 consecutive hours there is no clinical oversight and certain medications and procedures cannot be performed unless by an RN, which places residents at risk for delay of treatment.
