Missing Psychotropic Medication Consents

Summary

The facility failed to ensure residents were informed in advance and had documented consent for certain psychotropic medications before they were administered. For Resident #5, who had diagnoses including bipolar disorder, anxiety disorder, and depression and was cognitively intact with a BIMS score of 15, the record showed Divalproex Sodium was ordered and administered multiple times. The chart did not contain a consent form for Divalproex Sodium, and the only consent located in the record was an undated Informed Consent for Psychoactive Medications that did not list a medication name. Staff interviews confirmed the consent was not found in the resident’s EMR. For Resident #57, who had Alzheimer’s disease, bipolar disorder, and mood disorder and was moderately cognitively impaired with a BIMS score of 11, Sertraline HCl was ordered and administered beginning with the initial dose on 01/06/2026 and continued through later dose changes. The EMR did not contain a consent form for Sertraline HCl when reviewed. Although an Informed Consent for Use of Psychotropic Medication dated and signed 03/26/2026 was later located and identified as covering Sertraline for depression, staff stated it was not uploaded to the EMR and that the medication should not have been administered without the consent being in hand. The record also reflected earlier January administration of Sertraline without a consent found in the chart. For Resident #11, who had schizoaffective disorder and generalized anxiety disorder and a BIMS score of 5 indicating severe cognitive impairment, the record showed orders for Depakote Sprinkles and Risperdal. The DON stated the resident did not sign Form 3713 for Risperdal and Depakote, although a medication consent form had been signed. For Resident #86, who had seizures, bipolar disorder, schizophrenia, and moderate cognitive impairment with a BIMS score of 3, the record showed Ziprasidone HCl ordered as an antipsychotic/antimanic agent. The psychotropic medication consent in the chart was not the required Form 3713 and was not signed by the physician, and staff stated the required form could not be located.
