Missing Written Consent for Psychotropic Medications: The facility failed to obtain written consent before starting psychotropic medications for two residents. One resident had diagnoses including Parkinsonism, CKD, DM2, major depressive disorder, and dementia, and was receiving duloxetine and cimetidine for depression/anxiety and off-label sexually inappropriate behavior. Another resident with psychophysiologic insomnia and major depressive disorder was receiving sertraline and trazodone for depression and mood disorder. No consent forms documenting risks and benefits were found, and the UM and DON confirmed the forms could not be located.
A resident’s required annual MDS update was left incomplete, and the facility failed to complete the annual comprehensive assessment within the required 12-month timeframe. The DON stated the MDS coordinator was covering for the unit manager and herself, which caused the delay, while the MDS coordinator said she reviews the MDS dashboard daily. The DON also stated she did not know the facility was a month behind.
MDS assessments for two residents were not completed and transmitted within required timeframes. Record review showed quarterly assessments remained in progress, and the MDS Coordinator and DON said the work was behind because they had to cover for the DON during staffing shortages. The facility policy required assessments to be conducted and submitted within federal and state timeframes.
Delayed Pneumonia Vaccination After Consent: A resident who had representative consent for the pneumonia vaccine did not receive it in a timely manner. The record showed the vaccine remained unadministered months after consent, and the Infection Prevention Nurse stated the delay was related to the end of a COVID-19 outbreak and waiting for influenza vaccines to arrive because she did not like to give the vaccines at the same time. The nurse confirmed the resident should have received the pneumonia vaccine by then.
Delayed COVID-19 Vaccination After Consent: A resident who had consented to receive the COVID-19 vaccine did not receive it in a timely manner. The IP Nurse said the family wanted to wait until after a COVID outbreak ended and then delayed again while waiting for influenza vaccines to arrive, and she confirmed the resident should have already received the vaccine.

Resident #3 was admitted on 8/3/23, later discharged and re-admitted, and had diagnoses including Parkinsonism, chronic kidney disease, cellulitis, type 2 diabetes, major depressive disorder, and unspecified dementia. Current medication orders included Duloxetine HCl 30 mg by mouth twice a day for depression/anxiety and Cimetidine 200 mg by mouth in the morning for off-label use for sexually inappropriate behavior. Resident #54 was admitted with diagnoses including psychophysiologic insomnia and major depressive disorder, and current medications included Sertraline HCl 100 mg daily for depression and Trazadone 100 mg at bedtime for mood disorder, which was initiated on 10/23/25 and increased to 150 mg on 11/21/25. A record review found no psychotropic medication consent forms for either resident documenting that the risks and benefits of psychotropic medication use were explained before treatment was started. During interview, the Unit Manager stated consent forms are usually scanned into the computer system for each individual, but when they were not found she acknowledged she could not find that any of the forms had been completed. The DON stated the facility had an ongoing performance improvement plan for antipsychotic and psychotropic monitoring, initiated in February 2025, but said that plan did not address psychotropic medication informed consent forms.
