Failure to Thoroughly Investigate and Report Allegations of Abuse, Neglect, and Injury
Summary
The facility failed to thoroughly investigate and report three self-reported allegations involving abuse, neglect, exploitation, or mistreatment for three residents. The record showed that the facility did not have evidence that all alleged violations were thoroughly investigated and that the results were reported to the State Survey Agency within 5 working days of the incident. The deficiencies involved an allegation that a resident with severe cognitive impairment and dementia-related diagnoses had been exploited for $2,000 by a family member, a fall-related incident involving a resident with severe cognitive impairment who later had a right tibia and fibula fracture, and a fall involving a resident with moderate cognitive impairment who sustained head and facial injuries. For the resident alleged to have been exploited, the record showed severe cognitive impairment, dementia, and a history of needing redirection. The administrator stated the resident reported giving $2,000 to a family member while the resident was in the middle of a Medicaid application. She stated the facility created an APS report and self-reported concerns for exploitation and neglect, but she did not complete staff or resident interviews beyond one interview with the resident using the hospice social worker as translator. She also stated she did not complete the required 3613-A form and relied on APS and a third-party foster home advisory service for portions of the investigation. For the resident who fell and later was found to have a right tibia and fibula fracture, the record showed severe cognitive impairment, dependence for toileting, bathing, and dressing, and a fall risk care plan. The resident had an unwitnessed fall from a low bed and was found on the floor next to the bed, crawling on a floor mat. The administrator stated she was notified after the fall and later after the hospital transfer when the fracture was identified, but she only interviewed one nurse, did not document the interview, did not collect a statement, did not conduct safety surveys, and did not interview the resident. For the resident who fell while CNA C was providing care, the record showed moderate cognitive impairment, muscle weakness, osteoporosis, and no care plan focus for assisting with ADLs, transfers, or repositioning. The resident was found on the floor with hematomas to the forehead and eye, pain, and later bruising to the face and shoulder. The facility incident record and provider investigation report did not include detailed interviews, documentation reviewed, corrective actions, or assessment of the scope of affected residents, and the administrator stated she could not interview the resident or CNA C because she did not have enough knowledge in Spanish.
