Failure to Provide Written Discharge Notice and Appeal Information
Summary
The facility failed to notify a resident and the resident’s representative in writing of the transfer or discharge and the reasons for the move for 1 of 5 residents reviewed for discharge. The resident had diagnoses including atherosclerosis of native arteries of the left leg with ulceration of the calf, neuralgia, neuritis, peripheral vascular disease, acquired absence of another left toe, and infection of an amputation stump of the right lower extremity. Her quarterly MDS showed a BIMS score of 12 out of 15, indicating moderate cognitive impairment, and she required staff assistance with ADLs. The record also showed discharge planning was not already occurring for return to the community, and she did not want to talk about leaving the facility or returning to the community. The resident’s record showed an order for discharge with skilled nursing, home health services, OT/PT evaluation and treatment, wheelchair DME, and wound care if wounds were present upon discharge. A social services note documented that the SW, discharge planner, and administrator met with the resident and discussed that her discharge date was 7/3/26. The resident stated she did not want to go home, said she was refusing, and said she did not have an address for follow-up care. Nursing documentation showed she was discharged from the facility on 7/3/26 at 11:04 a.m., and the discharge instruction form stated she was discharged home with a family member/caregiver and referred to home health. During interviews, the BOM stated she gave the resident a 48-hour notice of discharge on 6/30/26, but also stated a written 30-day discharge letter was not needed if the resident had insurance and that she was unsure what information the discharge notice contained. She further stated there was no opportunity for the resident to appeal because no written notice was given. Other staff stated the resident’s insurance no longer covered her stay and that the written discharge form was only provided when the facility initiated the discharge. The resident stated she was not given a written discharge letter, was told her time was up, tried to make a verbal appeal, and was not told why she was being discharged. The facility’s blank transfer and discharge notice form and its policy both stated that the notice is required for facility-initiated discharges and must include the reason for discharge, effective date, discharge location, appeal rights, and ombudsman information.
