Summary

The facility failed to prevent neglect of 3 residents by nursing staff. An Abuse, Neglect and Exploitation policy defined neglect as failure to provide goods and services necessary to avoid physical harm, pain, mental anguish, or emotional distress. Resident 1 was cognitively intact and had a care plan requiring 2 persons and a sit-to-stand lift for transfers, but said a CNA used the lift alone, repositioned the straps several times, attempted to have the resident stand, and the resident slid to the ground, bruising both knees and pulling the shoulder and neck. The DON said the CNA did not report the incident and had not followed the care plan by using the lift without another staff member. Resident 2 was moderately cognitively impaired and had care plan risks for falls and bleeding related to anticoagulant therapy. The resident said they fell from the bed to the floor, hurt the right hip and leg, and hit the face, and that aides helped them back to bed without the nurse seeing them. The DON said the RN did not complete an incident report until 2 days later and stated there had been grievances and complaints about that RN regarding neglect of residents. Resident 3 was cognitively intact and had a witnessed fall with fractures to the right foot requiring a cast. The resident said an RN walking in the hall while talking on a cell phone struck the resident's right foot, apologized, and did not stop to assess the situation; the ADON said the grievance was investigated and a formal reprimand was completed.
