Summary

The facility failed to protect residents from verbal and physical abuse by one resident toward two other residents. The deficiency was based on interviews and record review showing that one resident, who had diagnoses including left-sided paralysis following a stroke, ataxia, and delusional disorders, was involved in abusive interactions with other residents. The resident’s assessment showed independence with ADLs, no memory problems, and the ability to make needs known. One resident reported that the other resident verbally attacked, threatened, sexually harassed, and yelled at them in the main dining room, and also used a derogatory term related to sexual orientation when passing in the hallway. The resident stated there had been a prior incident in which the other resident shoved a table into their abdomen and grabbed a television remote from their hand. During interview, the resident described feeling threatened, afraid, angry, upset, and frustrated by the behavior and stated there were no staff in the dining room during the altercation. A second resident, who had diagnoses including heart failure, kidney disease, and dementia and required supervision to maximum assistance with ADLs, was involved in a separate physical altercation. A staff RN heard yelling and observed the resident in the doorway of the other resident’s room, and the resident was seen kicking the second resident in the leg. The interim DON stated the first incident described by the resident was verbal abuse and later stated the altercation with the second resident was physical abuse, with the kicking done to prevent entry into the room.
