Failure to Timely Report Alleged Abuse and Neglect
Summary
The facility failed to report alleged abuse, neglect, or mistreatment to the Administrator and the State Survey Agency within the required timeframes for 2 residents. For Resident #27, the record showed an unwitnessed fall on 05/03/2026, but the Administrator stated he did not learn of the fall until 05/05/2026 or 05/06/2026. Staff interviews showed the CNA and CMA reported the fall to the weekend supervisor, but they did not report it directly to the Administrator. The weekend supervisor denied being notified of the fall. The resident had a BIMS score of 2, indicating severe cognitive impairment, and later developed bruising to the left eye, left hand, and above the eyebrow, with the resident not being assessed until 05/05/2026 and then sent to the hospital for further evaluation. For Resident #40, the record showed the resident was cognitively intact with a BIMS score of 14 and had diagnoses including acute respiratory failure with hypoxia and asthma. The resident stated that on 06/28/2026 she pressed her call light to be repositioned in bed, was told by CNA L that the aide would return, and after waiting about 4 hours she called 911 because she felt she had trouble breathing. The resident said EMS arrived, said she was fine, and repositioned her in bed. The EMR did not reflect a nursing progress note, change in condition, or assessment related to EMS being contacted or the resident alleging neglect, and TULIP did not reflect a report to the SSA. Staff interviews showed the incident was discussed among staff, but it was not reported immediately to the Administrator. LVN M stated she learned the resident had alleged neglect and that EMS had been called, but she did not document or report it because she assumed another nurse had done so. LVN N stated she learned of the call to 911 during report and did not tell anyone that EMS had come to the facility. RN O stated she spoke with the resident, who said she called 911 because she felt she had waited too long to be repositioned, but RN O did not report it to the Administrator or DON because she believed there had been no abuse or neglect. The DON and Administrator later stated the incident should have been reported on the day it occurred, and the Administrator said the report to the SSA was initiated only after he was notified later.
