Failure to Monitor Resident Smokeless Tobacco Use
Summary
The facility failed to ensure the resident environment remained as free of accident hazards as possible by not identifying, implementing, and monitoring processes for resident smokeless tobacco use for three residents. The report states the facility was a non-smoking property, yet residents were observed using chewing tobacco and nicotine pouches inside the building and on the sunporch, with spit cups and tobacco products left in resident rooms and common areas. Staff interviews showed that tobacco use by these residents was known to multiple employees, but there was no consistent facility process for oversight, inventory, or supervision of the products. R77 was admitted with diagnoses including cognitive communication deficit, alcohol-induced persisting dementia, and acute cough. His MDS showed a BIMS score of 11, indicating moderate cognitive impairment. His care plan noted that he had a behavior of spitting on the floor and used chewing tobacco provided by family, with an approach to provide a spit cup. Observations showed a Styrofoam cup with tobacco spit on his bedside table, a cup on the floor beside him on the sunporch, and R77 spitting into a cup while sitting with other residents present and no staff on the porch. R77 stated that he chewed tobacco, kept it on his person or in his dresser drawer, and that family brought it to him. R71 had diagnoses including vascular dementia with behavioral disturbance, cognitive communication deficit, schizoaffective disorder, and anxiety disorder, and his MDS showed a BIMS score of 8, indicating moderate cognitive impairment. His care plan identified that he used nicotine pouches. Staff stated that a nurse held his tobacco and that he received tobacco products from the Activities Director, who later confirmed she purchased, stored, and administered ON! nicotine pouches for him. R51 had diagnoses including vascular dementia and COPD, with an MDS BIMS score of 6 indicating severe cognitive impairment, and his care plan also identified nicotine pouch use. Staff reported that R51 chewed snuff and kept it in his pockets and dresser drawer. The Activities Director stated that families brought tobacco products for R77 and R51, that R77 kept chewing tobacco in a Ziplock bag on his person or in his nightstand drawer, that she had never received education or training to monitor tobacco use for R51 and R71, and that the facility did not maintain a product inventory log. Multiple staff members also stated they had not received training or education regarding resident tobacco use.
