Failure to Obtain Informed Consent for Psychotropic Medications
Summary
The facility failed to obtain consent and failed to inform residents or their resident representatives in advance of the risks and benefits of psychotropic medications before those medications were administered to 5 of 5 residents reviewed. The deficiency involved residents who were receiving antidepressants, antianxiety medications, and other psychotropic medications, and the record review showed that the medications were given as ordered even though the required consent documentation and advance education were not in place before administration. Resident #80 was admitted with major depressive disorder and was ordered sertraline 50 mg daily for depression. The electronic health record did not contain a psychotropic consent signed before the medication was first administered, and the resident stated that no one discussed the side effects or risks versus benefits with him and that he was not asked to sign consent before receiving the medication. Resident #72 was admitted with depression and anxiety and was ordered aripiprazole 5 mg daily and duloxetine 60 mg twice daily. The record did not show a signed psychotropic consent before administration, and the resident stated that neither the physician nor nursing staff discussed the medications with her and that she did not sign consent before receiving them. Resident #23 was admitted with severe dementia with behavioral disturbance and anxiety and received amitriptyline, fluoxetine, and lorazepam during multiple months of review. The record contained an informed consent form for lorazepam only, with no consent forms for amitriptyline or fluoxetine, and there was no documentation that the resident representative was informed in advance of the risks and benefits of those psychotropic medications before administration. Resident #32 was admitted with dementia and insomnia and received trazodone for insomnia, but the record did not show documentation that the resident or resident representative was informed in advance of the risks and benefits before the medication was given. Resident #105 was admitted with anxiety and depression and was ordered buspirone, duloxetine, and lorazepam; the record showed no signed psychotropic consent before the medications were started, and the resident stated she did not recall any discussion of risks, benefits, or side effects and was not asked to sign consent before receiving the medications.
