Failure to Provide Advance Directive Education and Documentation
Summary
The facility failed to provide written information about advance directives and/or an opportunity for residents to formulate advance directives, and failed to obtain and maintain advance directive documentation in the medical record for 11 of 30 residents reviewed. The affected residents included individuals who were cognitively intact as well as residents with moderate to severe cognitive impairment. Several residents had physician code status orders already in place, including Full Code or Do Not Resuscitate orders, but the records did not show documentation that advance directive education or an opportunity to complete advance directives had been offered. Resident #83 was admitted with diabetes, kidney disease, and hypertension, had a Full Code physician order, and was cognitively intact on admission MDS assessment. During interview, the resident stated he did not recall receiving written education regarding advance directives, and the record contained no documentation of such education or an opportunity to formulate advance directives. Similar findings were identified for Resident #81, who was admitted with rhabdomyolysis and dysphagia, had a Full Code order, was cognitively intact, and also did not recall receiving written advance directive education; the record again lacked documentation. Resident #18, who had peripheral vascular disease and atrial fibrillation and a Do Not Resuscitate order, was cognitively intact and likewise did not recall receiving written education, with no documentation in the record. Additional residents with missing documentation included Resident #1, Resident #2, Resident #4, Resident #41, Resident #50, Resident #54, Resident #55, and Resident #100. These residents had diagnoses such as stroke history, diabetes, hypertension, chronic kidney disease, heart disease, congestive heart failure, chronic respiratory failure, and atrial fibrillation, with cognitive status ranging from cognitively intact to moderately or severely impaired. Interviews with residents who could respond showed they did not recall receiving written advance directive education, and attempts to contact some resident representatives were unsuccessful. The DON stated the facility only discussed code status with the resident and/or responsible party, and the Regional President of Operations stated recent turnover in the Social Worker role resulted in the failure to ensure residents or their representatives received advance directive education.
