Failure to Obtain Informed Consent for Psychotropic Medications
Summary
The facility failed to obtain informed consent and failed to ensure residents or their responsible parties were informed in advance of the risks and benefits of psychotropic medications before the medications were administered and/or before dosage changes for three residents. The deficiency involved psychotropic medication consent processes that were not completed consistently, including missing consents, incomplete consents, and consents that did not match the current ordered doses. One resident with bipolar disorder, depression, and anxiety was cognitively intact and receiving sertraline, lamotrigine, and buspirone. The record showed medication dose changes for sertraline and lamotrigine, but the psychotropic consent form signed by the resident listed incorrect or incomplete medication doses. The resident stated he received a consent form about a month earlier but did not recall any discussion about the dose changes, and he said this was the first consent he had been asked to sign since admission. A second resident with severe dementia with behavioral disturbance and anxiety was receiving alprazolam and quetiapine. The consent form in the record was signed by the responsible party after the medications had already been administered for months, and the nurse who completed the form stated she had not provided education or obtained consent before the initial administration. The responsible party stated the nursing staff had not discussed the medications with her and she did not recall signing the consent form. A third resident with dementia with behavioral disturbance and anxiety was receiving multiple psychotropic medications, including quetiapine, lorazepam, mirtazapine, buspirone, and sertraline. The record did not contain a psychotropic medication consent form. Nursing staff stated the consent must have been overlooked, and the DON later stated the consent could not be found and that it must have been forgotten prior to administration. The responsible party stated she knew the resident was receiving psychotropic medications but had not been told about the side effects associated with the antipsychotic and had questions about the risks and benefits.
