Incomplete Informed Consent for Psychotropic Medications
Summary
The facility failed to obtain comprehensive informed consent for psychotropic medications for Residents 2, 3, 4, 14, and 29. The report states that the facility’s resident rights policy required residents to be fully informed, and the psychotropic medication policy required residents, families, and/or representatives to be informed in advance of the risks and benefits, black box warnings, and treatment alternatives before a psychotropic medication was initiated or increased. During interview, the DON confirmed the facility consents were not comprehensive and did not include the symptoms and/or diagnoses being treated, potential effects, potential adverse effects, or alternate non-pharmacological treatment options. Resident 29’s record showed diagnoses including Alzheimer’s dementia, anxiety, depression, and a psychotic disorder, and the resident received Seroquel and Lexapro. The informed consent form listed those medications, but it did not identify the diagnoses or symptoms being treated and did not include potential effects, adverse effects, or alternate treatment options. Resident 4 was cognitively intact, had no behaviors, and received Abilify, Lexapro, and Klonopin for diagnoses including heart failure, MDRO, anxiety, and depression; however, the consent form was undated, did not match the current dosages, and did not identify the diagnoses or symptoms, potential effects, adverse effects, or alternate options. Resident 2 was cognitively intact, had delusional behaviors, and received Haldol, Seroquel, Venlafaxine, Klonopin, and Ativan for diagnoses including non-traumatic brain dysfunction, anxiety, bipolar disorder, and schizophrenia, but the consent form did not document the diagnoses, side effects, or alternative non-pharmacological treatment options. Resident 3 was cognitively intact, had no behaviors, and received Celexa, Lorazepam, and Loxapine for dementia, anxiety, psychotic disorder, schizophrenia, and PTSD, but the consent form lacked the diagnoses, side effects, and alternatives. Resident 14 had severe cognitive impairment, rejection of care, wandering, and other behaviors, and received Buspirone, Mirtazapine, and Olanzapine for schizophrenia, depression, and anxiety; the medical record contained no evidence that informed consent for psychotropic medications was obtained before administration.
