Failure to Provide Written Bed-Hold Notices During Hospital Transfers
Summary
The facility failed to provide written bed-hold or transfer notices when residents were transferred to the hospital. R32 was cognitively intact, had diagnoses including anemia, irregular heartbeat, high blood pressure, liver disease, kidney failure, and diabetes, and was dependent on staff for toileting, transfers, and showering. R32 was sent to the hospital on 6/30/26 for altered mental status, and the record showed a bed-hold discussion by telephone with the resident representative/POA; however, the written copy field on the transfer/bed-hold notification was blank. R32 later returned from the hospital with right internal carotid artery narrowing, was sent out again on 7/4/26 for a nosebleed that could not be controlled, and was sent out again on 7/7/26 for continued vaginal bleeding, lethargy, and weakness. The medical record lacked evidence that a bed-hold and/or transfer notice was given for the 7/4/26 and 7/7/26 hospital transfers. R9 was cognitively intact and had diagnoses including diabetes, neurogenic bladder, and kidney disease. R9 was transferred to the hospital on 7/11/26 after complaining of lower abdominal pain and thinking she might be passing a kidney stone. The record lacked evidence of a bed-hold notice, and progress notes from 7/11/26 through 7/16/26 did not show discussion or written notice regarding bed hold. During interview, R9 stated she remembered a conversation about bed hold but was not given anything in writing. Staff interviews showed the facility’s process was inconsistent. An LPN stated she verbally explained bed hold and completed the transfer/bed-hold assessment in the computer, but did not usually print one out for the resident or family. The SSD stated the nurse completed the bed-hold assessment in the computer and that she would print it out for the resident when they returned, while the DON stated staff were expected to obtain a bed hold upon transfer or as soon as possible and print the form for the resident. The facility’s Bedhold Notice Policy required written information to be provided at admission and at the time of transfer to the hospital or therapeutic leave, and for emergency transfers within 24 hours, with a signed and dated copy kept in the record.
