Failure to Provide Ordered PT/OT Services

Cummings Health Care FacilityHowland, Maine Survey Completed on 07-14-2026

Summary

The facility failed to provide specialized rehabilitative services or obtain those services from an outside provider for one resident with Parkinson's disease and functional decline. The resident had physician orders for PT/OT evaluation and treatment dated 12/16/25 and again on 1/16/26, and the record also included a communication note from the resident's family/POA stating they wanted PT and OT resumed and were willing to pay the out-of-network co-pay. Despite these orders and requests, there was no evidence that a PT/OT evaluation and treatment was initiated or completed during that period. The record later showed another physician order for PT and OT evaluation and treatment dated 4/21/26, and a PT evaluation and plan of treatment with start of care on 4/27/26. That evaluation documented that the resident presented to therapy following functional decline related to late-stage Parkinson's disease and had experienced a recent fall in the room, with decline over the prior months. The PT discharge summary stated the resident was discharged the same day due to a change in payer source. During interviews, the PT stated the resident did not receive PT services until 6/1/26, which was months after the earlier physician order, and the Administrator stated the facility had been waiting for a new insurance contract after losing its prior therapy contract and later brought therapy staff in-house.

Facility policy required therapists to screen all new admits and include specialized rehab services in the admission process.
