Summary

The facility failed to thoroughly investigate an alleged incident of neglect involving a resident with ALS who reported that he had not received adequate care from a CNA, felt unsafe, and believed someone was trying to kill him. The facility also failed to protect residents from further potential neglect while the investigation was in progress. The CNA identified in the allegation was not suspended and worked the next night shift on the resident’s unit, despite the facility’s policies stating employees suspected of abuse or neglect should be removed from direct care during the investigation. The DON stated she was informed of the allegation before 7:00 PM, and the HR coordinator confirmed the CNA was not suspended until she was terminated the following day for unprofessional conduct. The administrator acknowledged the CNA should not have been allowed to work that shift to protect residents during the investigation.
