Failure to Report Allegations of Abuse and Financial Exploitation
Summary
The facility failed to implement necessary interventions to protect one resident from abuse. The resident had diagnoses of Alzheimer’s disease, depression, and diabetes mellitus, and the MDS documented a BIMS score of 08, indicating moderate cognitive impairment. The resident’s niece reported that the banking institution notified her of potentially fraudulent charges involving checks written by the resident’s ex-stepdaughter, who was also the facility Administrator and one of the resident’s powers of attorney. The niece also reported concerns about medical decisions and care, and stated that she filed a protection order on behalf of the resident against the former Administrator, which was served on 3/30/26. Facility documentation showed that APS came to see the resident and requested a medication list, and the note stated APS planned to return but did not come back. An APS worker reported that she informed the Executive Director of Operations of allegations of financial exploitation by the former Administrator and concerns that the resident was sleeping on the couch. The APS worker stated that when she raised the allegations, the Executive Director of Operations responded that they were allegations and would remain allegations until APS completed the report. The APS worker also provided that on 03/13/2026, the Executive Director of Operations was informed of the concerns and stated that the former Administrator would remain in place until completion of the assessment. The former DON acknowledged that the resident’s niece had expressed concerns about financial and medical decisions made by the former Administrator, including hospice care and POA issues, and stated she communicated those concerns to the Executive Director of Operations. However, she stated that until something was proven, there was nothing the facility could do, and that the concerns did not warrant reporting to DIAL. Instead of initiating an investigation or report, she stated that the Executive Director of Operations instructed her to document and keep an eye on it. The facility policy required all allegations of abuse to be reported immediately to the charge nurse and then to the Administrator or designated representative, with abuse reported to the Iowa Department of Inspections and Appeals not later than two hours after the allegation was made.
