Summary

The facility failed to ensure a 30-day notice was issued before a facility-initiated discharge for one resident. The resident was cognitively intact, had an overall goal to remain in the facility, and had no active discharge planning to return to the community. His diagnoses included cellulitis of the left lower limb, peripheral vascular disease, chronic ulcers of the left lower leg and heel, and an acquired absence of the right leg above the knee. Hospital documentation also showed a history of homelessness and prior difficulty with safe discharge placement. The record showed multiple grievances filed by the resident in June, along with notes describing conflicts with dietary staff and verbal aggression toward another resident. On the day of discharge, the resident was placed on one-on-one observation, family and physician were notified, and the physician ordered transfer to an inpatient psychiatric facility. The resident refused inpatient psychiatric placement and said he would go to an address provided. Documentation did not show that he could perform his wound care himself, who lived at the discharge address, or whether that person agreed to accept him there. Other notes also lacked documentation explaining why referrals were made to psychiatric facilities if the resident was voluntarily discharging. A nurse practitioner documented that the resident had repeated threatening behavior toward staff and other residents and that the facility determined discharge was medically and administratively necessary. The resident was discharged to the provided address the same day. The Executive Director stated she did not give the resident a 30-day notice of transfer or discharge and did not feel it was required, despite acknowledging the nurse practitioner documented the discharge as facility-initiated. The facility policy stated residents should receive reasonable advance notice, generally 30 days before transfer or discharge unless exigent circumstances exist.
