Failure to Document and Investigate Resident Grievances
Summary
The facility failed to ensure that a resident on the secured memory care unit had access to grievance forms or had grievances submitted on her behalf regarding another resident repeatedly entering her room. The resident stated she had ongoing concerns that the other resident kept trying to enter her room and disturb her after she returned from the hospital following brain surgery. She reported telling aides, nurses, and family members about the repeated intrusions and said she had seen grievance forms in the hallway but could not find any available on the unit when she looked for them. She also stated she did not know whether anyone had filed a grievance for her and believed none had been submitted because the other resident continued entering her room. During observation, the secured memory care unit had no grievance forms available. Staff interviews confirmed the other resident continued to focus on the resident’s room and that staff had difficulty keeping her away from it. The other resident was observed wandering the hallway, approaching the front unit door, and moving close to the resident’s room while multiple staff members attempted to redirect her. Staff also reported that the other resident rummaged through the resident’s belongings and took items. The Executive Director, DON, and Regional Clinical Support later acknowledged that grievance forms should be available for all residents, including those on the memory care unit, and that verbal grievances should be documented with investigations and outcomes. The facility also failed to ensure a grievance related to a resident’s mattress discomfort and pain was submitted and investigated. The resident, who had diagnoses including obesity, osteoarthritis of both knees and hips, spondylosis, sciatica, and chronic pain, stated her old low air loss mattress inflated and deflated in certain places and caused severe pain. She reported that the pain was so intense she called 911 and went to the ER to get off the mattress. Records showed she requested the ER for pain on one occasion and later cried that she was uncomfortable in the bed and wanted it changed, with the DON notified. The resident’s care plan addressed pain management, and the ED stated the facility had tried multiple mattresses, but the record review found no documentation that the mattress concern was submitted or investigated as a grievance.
