Failure to Provide Written Transfer Notice and Bed-Hold Information
Summary
The facility failed to provide the resident and the resident representative with written notification of transfer and bed-hold policy information at the time of transfer or as soon as practicable for one resident reviewed for discharge process. The resident’s record documented diagnoses including generalized anxiety disorder, hypothyroidism, hyperlipidemia, depression, lack of coordination, muscle weakness, and schizophrenia. The resident’s MDS assessment documented a BIMS score of 15, indicating intact cognition, and the record also identified an Office of State Guardian representative as the resident’s guardian. The resident became agitated after not being allowed to call the guardian more than two times per day, and staff documented that the resident used racial slurs and made threatening statements. The sheriff’s department was notified, arrived at the facility, and took the resident to the ER for a psychiatric evaluation. The resident was later transferred from the ER to an in-state behavioral health/psychiatric hospital approximately 5 hours away, and facility staff were notified of the transfer. Progress notes also documented that the resident remained out of the facility at the psychiatric hospital for multiple days. The record did not show evidence that the resident or the guardian received written notice of transfer that included the reason for transfer, effective date, location of transfer, appeal rights, or the required ombudsman and protection and advocacy contact information. The record also did not show evidence that written bed-hold information was provided before transfer. The guardian stated she received only a voicemail and later a call from the ER, and she reported that she did not receive the facility’s bed-hold policy until it was emailed 11 days after the transfer, after the bed-hold period had already expired. Staff interviews indicated that they typically placed the bed-hold policy in the transfer packet but did not explain it to the resident or representative and did not routinely notify the representative about the bed-hold policy.
