Failure to Protect Resident From Abuse and Report Incident

Summary

The facility failed to implement and follow its Abuse Prevention Policy and Procedures after a physical and verbal altercation between a resident and a CNA. The resident had diagnoses including dementia with behavioral disturbance, type 2 diabetes mellitus, chronic kidney disease with heart failure, major depressive disorder, unspecified psychosis, neuromuscular dysfunction of bladder, benign prostatic hyperplasia, and Parkinson’s disease. His assessment documented moderate cognitive impairment with a BIMS score of 11, and his care plan identified that he could display aggression toward staff and peers and could be at risk for abuse due to dementia. Witness statements and interviews described an incident in which staff observed a physical struggle between the resident and the CNA in or near the resident’s room during the overnight shift. The resident stated that he asked for a towel after urinating on the floor, that the CNA became angry, threw him to the ground, and that his hip hurt. He also stated that he hit the CNA because he had to and that he was scared she would fight him again. Multiple staff interviews described hearing commotion, seeing the resident and CNA on the floor or in each other’s arms, and separating them. One staff member stated the CNA said she had dragged the resident and another reported hearing the CNA say she had knocked him out. The facility did not immediately report the allegation of abuse to the state agency, and the incident was not found on the state agency reportable incidents review. The investigation was not initiated in a timely manner, and required documentation was missing or incomplete, including the incident report, resident assessment, physician notification, family notification, and progress note. Interviews also showed confusion about who was responsible for the resident’s assessment and documentation, and the administrator and other leaders acknowledged that the resident should have been assessed, the physician and family notified, and the incident reported and investigated. The surveyor identified this as an Immediate Jeopardy beginning with the altercation and later confirmed that the Immediate Jeopardy was removed, while noncompliance remained.
