Failure to Investigate Missing Fentanyl Patches and Medication Administration Concerns
Summary
The facility failed to thoroughly investigate an allegation of medication misappropriation involving a resident with malignant neoplasm of the bronchus/lung, secondary malignant neoplasm of the intrathoracic lymph nodes, chronic pain syndrome, and palliative care needs. The resident’s care plan identified a need for assistance with ADLs, monitoring for pain, and administration and documentation of pain medications. On 5/18/26, RN #2 documented that both fentanyl patches had been removed by the resident, but the patches could not be located after searching the room. RN #2 educated the resident and a family member and instructed them to give any removed patches to nursing staff, but she did not initiate an investigation or obtain statements from staff who had contact with the resident. LPN #4 later reported that when he checked the resident’s fentanyl patches during the day shift, he could not locate either the 12 mcg or 25 mcg patch and the resident could not identify their whereabouts. He immediately notified RN #2. RN #2 stated she performed a body check and searched the sheets and garbage without finding the patches, assumed the resident had removed them, and notified the DON only for new orders. The DON stated she was not notified at the time, later reviewed the documentation, and acknowledged that when fentanyl patches could not be located, staff and visitor statements should have been obtained and an investigation should have been initiated. The facility also failed to thoroughly investigate an allegation of neglect related to medication administration for the same resident. Camera footage showed the resident received medications from an LPN at 7:58 PM, and no nursing staff were observed entering the room again until an RN entered at 5:29 AM, when she was heard identifying she was administering Klonopin and pain medication. However, the RN documented oxycodone doses at 12:00 AM and 4:00 AM, and the controlled substance record showed those doses as removed from stock. Camera footage did not show the RN entering the room at those times. The resident was also observed later requesting the hospice nurse and stating not feeling well, but the progress notes did not document missed or late medications or the resident’s request. The DON reviewed the MAR and controlled substance record, determined the allegation was unsubstantiated, and did not initiate a further investigation or obtain statements from staff assigned to the overnight shift.
