Failure to Protect Residents from Sexual and Physical Abuse
Summary
The facility failed to protect residents from abuse in three separate incidents involving resident-to-resident sexual abuse and physical abuse. The report states that three of five reviewed residents were not kept free from abuse: one resident was sexually abused by another resident, a second resident was sexually abused by another resident, and a third resident was physically abused by another resident. The facility’s abuse policy required protections from abuse and protocols to prevent and identify abuse or mistreatment, including education and measures to prevent sexual abuse. One incident involved a cognitively intact female resident with diabetes, difficulty walking, anxiety, and depression who reported that another resident with stroke-related paralysis, cognitive communication deficit, traumatic brain injury history, anxiety, depression, and behavioral/personality disorders grabbed her breast while he was in his wheelchair near the bird cage. The resident said she told him to stop and did not initially report it because she was not afraid of him. The assailant had a prior history of inappropriate physical contact with female staff and/or residents and had previously been placed on one-to-one supervision after earlier incidents, but his behavior care plan was not revised after this event. The facility later documented that he was to be discharged to protect other residents, but he remained at the facility after the discharge was appealed. A second incident involved a resident with cerebral palsy, quadriplegia, irritability, anger, and moderate cognitive impairment who was kissed on the lips by another resident with dementia, depression, unsteady gait, difficulty walking, and severe cognitive impairment. The resident said she did not ask to be kissed and was upset when he kissed her a second time the same day; she also said she felt unsafe and did not like him kissing her. The facility described the event as isolated and did not substantiate sexual abuse, citing the resident’s history of attention-seeking behavior and the other resident’s cognitive impairment and poor impulse control. The resident who initiated the kissing had a history of similar behaviors and was evaluated for transfer to a memory care unit, but the report states the sexual abuse did occur. The third incident involved a resident with congestive heart failure, malnutrition, dementia, high blood pressure, and cognitive communication deficit who used a manual wheelchair and had moderate cognitive impairment. He was in an altercation with another resident who had COPD, alcoholic liver disease, morbid obesity, difficulty walking, lack of coordination, and was cognitively intact. A witness reported hearing the second resident threaten to run over the first resident’s feet and then intentionally run over his toes with a wheelchair. The facility did not substantiate physical abuse because both residents had behavioral responses toward each other, but the report states physical abuse did occur when the wheelchair was intentionally used to run over the resident’s toes.
