Summary

The facility failed to protect a resident’s right to be free from sexual abuse when a CNA was accused of sexually abusing the resident during incontinence care. The resident was admitted with diagnoses including DM-2 and paraplegia, and the MDS indicated moderate cognitive impairment, wheelchair use, and dependence on staff for eating and multiple ADLs, including toileting hygiene and transfers. The resident reported that the CNA touched his penis hard while he was requesting to be changed, and the resident told the night supervisor about the allegation. According to the record and staff interviews, the CNA remained in the facility after the allegation and continued working with other residents during the same shift and again on the following night shift. The RN documented that the resident complained of the CNA allegedly touching him inappropriately and that a new CNA would be assigned to the room. The staffing records showed the CNA was assigned to multiple residents on both shifts after the allegation, and the DON and AADM stated the CNA should have been suspended right away but was not. The facility’s abuse prevention policy stated that staff accused of abuse, neglect, or mistreatment are to be suspended until the investigation is complete and the findings have been reviewed by the Administrator, and they are not to be reinstated to regular assignment until the allegation is unsubstantiated. The facility’s 5-day summary stated the allegation could not be substantiated, but the CNA had already remained in the facility and provided care to other residents before that determination was made.
