Failure to Report Resident-to-Resident Abuse Allegation
Summary
The facility failed to report an allegation of physical abuse to The Department within the required time frame and failed to provide a 5-day investigative report after a resident-to-resident altercation involving two residents. The incident involved one resident with diagnoses including cellulitis, sepsis, psychosis, and schizophrenia, whose cognitive assessment indicated he was rarely or never understood and had long- and short-term memory problems. The other resident had diagnoses including a psoas muscle abscess, sepsis, diabetes, and heart failure, and his cognitive assessment showed a BIMS score of 15 out of 15, indicating intact cognition. Documentation showed that the cognitively intact resident reported that the other resident tried to take his phone, threw objects in the room, and struck him with a basin, causing a small scab below his lower right lip. He later reported that the other resident returned, climbed on him, was naked, and slapped him on the left side of his face. Staff notes also documented that the resident in the other bed was interviewed and could not provide information about the event, and an interdisciplinary review noted his schizophrenia, psychosis, impaired cognition, and impaired judgment may affect his ability to perceive and respond to his surroundings. Facility staff and leadership gave inconsistent accounts of reporting requirements. The DON stated the facility followed a newly implemented mandated reporter flowsheet that directed staff to contact the ombudsman and law enforcement if the resident had dementia and no serious bodily injury, and staff stated they believed the incident did not need to be reported to The Department because the resident was confused. Other staff stated abuse allegations should still be reported to The Department, the ombudsman, and law enforcement. The DON acknowledged The Department had not been notified and that a 5-day investigation report was not sent. The facility policy stated allegations of abuse were to be reported not later than 2 hours after the allegation was made, local law enforcement and the ombudsman were to be notified, and findings of completed investigations were to be reported within five working days.
