Failure to Notify Physician of Resident Aggression Episodes

Summary

The facility failed to implement the care plan for one resident when the resident’s physician was not notified of episodes of aggression. The resident’s care plan identified psychosocial-behavior concerns, including verbal aggression toward staff and peers and physical aggression toward staff and peers, with a goal that the resident would have needs met and would not harm self or others secondary to socially inappropriate and/or disruptive combative behavior. The care plan interventions included documenting and recording behavioral episodes and notifying the physician of episodes of aggression and abusive behaviors. A review of the resident’s psychotropic MAR showed multiple episodes of verbal aggression, including cussing or yelling at other residents on several shifts across the review period. A review of the resident’s progress notes showed no documentation of physician notification for the listed verbal aggression episodes. During interviews, the DON confirmed there was no documented evidence of physician notification for those episodes and stated that there should be documented evidence. The facility’s policy on care plans stated that the comprehensive person-centered care plan describes the services to be furnished to attain or maintain the resident’s highest practicable physical, mental, and psychosocial well-being, and the change-in-condition policy stated the nurse will notify the attending physician or physician on call when there is a specific instruction to notify the physician of changes in the resident’s condition.
