Summary
The facility failed to ensure its administrator was managed by a state licensed nursing home administrator when the Operations Assistant, who was not licensed as an NHA in the state at the time, was assigned and functioned as the administrator. The report states the facility posted Administrator 1’s NHA license on the wall, but Administrator 1 did not actually perform the administrative duties. Administrator 1 stated the Operations Assistant operated essentially as the administrator without a license, was at the facility daily, and provided telephone updates, while Administrator 1 had never spoken to one resident and was not familiar with that resident’s grievance report because the Operations Assistant completed it. Records and interviews showed the Operations Assistant was listed by the facility as the administrator from 1/16/26 to 3/6/26, while the state licensing database showed the Operations Assistant was not licensed as an NHA until 1/16/26. Facility records also showed Administrator 2 was the administrator until 1/15/26, and Human Resources records listed Administrator 2’s termination date as 9/18/25 and the Operations Assistant’s hire date as 9/30/24 with a termination date of 3/6/26. Staff interviews indicated multiple employees and a resident identified the Operations Assistant as the administrator, and one RN stated they did not know who Administrator 1 was. The report also included resident-related records showing Resident 11 had behavioral complaints involving CNA care and that the administrator and ombudsman were involved in addressing those concerns. Resident 12’s record showed admission for pressure ulcer care, diabetes, and weakness, with a BIMS score of 15 and weekly nursing documentation describing the resident as alert and oriented with no vision or hearing impairments. Facility job descriptions for Administrator and Operations Manager had identical duties and qualifications, both requiring an administrator license, and the facility policy stated the Administrator is responsible for investigating and resolving grievances and complaints.
