Failure to Provide Discharge Information in the Representative’s Language

Summary

The facility failed to provide discharge information to the resident’s representative in a language she understood for one resident who was discharged home with home health services. The resident had chronic respiratory failure with hypoxia, tracheostomy status, spastic quadriplegic cerebral palsy, a stroke with left-sided loss of movement, and aphasia. The admission MDS indicated the resident’s cognitive skills for daily decision making were severely impaired, that he had no speech pattern, and that he was rarely or never able to make himself understood or understand verbal content communicated to him. Social Services met with the resident and the representative and used a language-line interpretation service because the representative was Spanish-speaking. Later documentation showed the family was Spanish-speaking, although one respiratory therapy note stated the representative was fluent in spoken English and the resident’s father spoke minimal English. An email from the Ombudsman stated the representative reported that her interactions with the Director of Social Services had been conducted in English without interpretation services, and the Ombudsman expressed concern that the representative may have misunderstood instructions related to discharge planning and durable medical equipment. The discharge form and discharge summary documented that discharge information, including written education regarding tube feeding, tracheotomy care, and medications, was provided to the representative in English. The discharge form contained the representative’s signature but no documentation that an interpreter was used, no interpreter identification number, and no evidence that the written information was provided in Spanish. A progress note also stated discharge instructions were given to the representative, but there was no documented evidence that they were relayed in Spanish or that an interpreter was used during the discharge communication.
