Failure to Protect Residents from Verbal Abuse

Oasis Pavilion Nursing & Rehabilitation CenterCasa Grande, Arizona Survey Completed on 07-21-2026

Summary

The facility failed to protect two residents from verbal abuse by another resident during a dining room incident in which one resident repeatedly called the other derogatory names. One resident, who had diagnoses including noninfective gastroenteritis and colitis, unspecified protein deficiency, alcohol use, and dependence on renal dialysis, had a care plan noting behavioral problems related to attention seeking and impulsive responses when verbally aggressive words were used toward him. His record also showed he was cognitively intact with a BIMS score of 13. Another resident, who had diagnoses including severe dementia without behavioral disturbance and Parkinsonism, also had a care plan noting impulsive behavior and attention seeking when frustrated, and his BIMS score was also 13. According to the facility report and staff interviews, the two residents were seated together at lunch with a third resident when the second resident began calling the first resident derogatory names and did not stop after being asked to stop. The first resident then approached the second resident and made a motion toward his shoulder and chest, but the facility report stated no physical contact was made. A dietary aide stated he heard the second resident loudly call the first resident a derogatory name and described the exchange as angry rather than joking. Another resident who witnessed the event stated the second resident loudly called the first resident a derogatory name, continued yelling expletives, and that the first resident moved toward him in response. The DON stated that verbal abuse includes derogatory statements made to other residents and confirmed during her investigation that the second resident had a history of impulsive and aggressive language and used that language during the incident. Psychiatric progress notes also documented that the first resident described the conflict as being triggered by the second resident calling him names, and the second resident admitted he called the first resident a derogatory name when frustrated. The facility policy stated that abuse by anyone, including other residents, would not be condoned and defined verbal abuse as disparaging or derogatory language toward residents or within hearing distance of residents.

Instead, a nurse aide transferred the resident with only one staff member during a toilet-to-wheelchair transfer, and the resident heard a pop and developed increased pain. X-ray and hospital imaging confirmed fractures of the distal R tibia and fibula, and the facility substantiated neglect for not following the care plan.
