Failure to Report Allegation of Sexual Abuse

Arizona State Veteran Home-phxPhoenix, Arizona Survey Completed on 07-28-2026

Summary

The facility failed to report an allegation of sexual abuse within the required timeframe for one sampled resident. Resident #67 was admitted with diagnoses including hemiplegia, hemiparesis, testicular hypofunction, and depression. A quarterly MDS assessment documented a BIMS score of 14, indicating intact cognition, and also noted no psychosis or behavioral symptoms. The SA complaint/incident tracking system showed that another state agency reported an allegation that a staff member was sending explicit content to Resident #67 in exchange for money. Facility records included two undated staff statements and an incident timeline. One CNA stated he overheard a rumor that a resident had pictures of a staff member and thought it should be reported to the administrator. The administrator’s statement indicated that the facility learned of a rumor that Resident #67 had inappropriate pictures on his phone of a CNA, and that the resident denied having the photos when asked. The administrator also stated the facility knew APS had been at the resident’s room the week before, but did not know why. Further review found no evidence that the facility reported the allegation to the SA. Interviews with the RN supervisor, DON, and administrator showed they understood allegations of abuse had to be reported within 2 hours and that sexual abuse would include a staff member sending or selling inappropriate photos to a resident. The DON and administrator both acknowledged the facility did not report the allegation because they did not view it as abuse after the resident denied having the photos. The administrator also stated that no other residents or staff were interviewed about the allegation, and the facility policy required allegations of abuse to be reported within required timeframes and thoroughly investigated.
