Failure to Report and Investigate Alleged Sexual Abuse
Summary
The facility failed to implement written policies and procedures to prevent, report, and investigate an allegation of sexual abuse involving one resident who had a BIMS score of 14 and intact cognition. The resident was admitted with diagnoses including hemiplegia and hemiparesis following cerebral infarction, testicular hypofunction, depression, hypothyroidism, anemia, hypertension, and age-related osteoporosis. The allegation involved rumors that a former CNA had sent or sold inappropriate photos of herself to the resident, and the facility’s own records showed that the administrator was informed of the allegation on 6/30/2025. The incident review contained two undated staff statements. One CNA stated he overheard another CNA saying a resident had pictures of a staff member and that they were laughing about it, and he believed it was enough to report to the administrator. The administrator’s statement reflected that the CNA reported hearing a rumor that the resident had inappropriate pictures on his phone of a CNA. The administrator stated she spoke with the resident, who denied having the photos and said APS had been there the week before asking the same questions. The administrator also stated the facility knew APS had visited but did not know why. Interviews showed staff understood that allegations of sexual abuse were to be reported immediately or within 2 hours to the administrator and outside agencies, and several staff stated that a staff member sending or selling inappropriate photos to a resident would be sexual abuse. The DON stated the facility had an allegation that the former CNA sent inappropriate photos to the resident, that APS had come out before the facility was alerted, and that the facility did not report the allegation because the resident denied having the photos. The administrator similarly stated the allegation was not reported because she did not see it as abuse after the resident denied it, and she said she only conducted a small investigation by asking the resident about the photos. The facility policies reviewed stated that all allegations of abuse were to be reported immediately, thoroughly investigated, and that the accused employee would be placed on leave with no resident contact until the investigation was completed.
