Summary

The facility failed to ensure a resident’s grievance was handled in accordance with its grievance policy after the resident’s family member voiced concerns about care and services. The concerns involved whether a portable oxygen tank was full when the resident was sent to a physician appointment and whether the resident’s Foley catheter had been cleaned. The grievance concern report dated 02/19/26 showed the family wanted to ensure the oxygen was full and the Foley had been cleaned, and a meeting with the IDT was noted for 02/23/26, but several required grievance form fields were left blank, including the date assigned, date to be resolved by, whether a group meeting was held, what action was taken, results of action taken, whether the care plan was updated, resolution of concern, and the Executive Director’s signature. The resident had multiple serious diagnoses and conditions, including dry gangrene of both lower extremities, peripheral artery disease, CVA history, gastrostomy tube dependence, Foley catheter use, osteomyelitis, aspiration pneumonia, chronic kidney disease on hemodialysis, fungal cellulitis of the groin and perineal area, and acute respiratory failure. The resident’s record also showed continuous oxygen therapy and a care plan addressing the Foley catheter and respiratory needs. The resident was readmitted from the hospital on 04/14/26 and expired at the facility on 04/15/26. During interviews, the Executive Director stated he was responsible for addressing grievances and completing grievance forms, but he had not documented in the medical record when he called the family to schedule a meeting and could not remember why the meeting had not been held as requested. He also acknowledged the facility had not completed a grievance form when the family called to report concerns about the resident’s care and services. The DON said she was not aware of the family’s concerns, while Human Resources T stated the family had called asking for a meeting and voiced concerns about an empty oxygen tank and the catheter. The facility’s grievance policy required complaints to be given to the Executive Director or designee, documented immediately, reviewed with IDT members, and resolved with written documentation, but the record showed these steps were not completed as required.
