Summary

The facility failed to ensure that a resident with severe cognitive impairment and a history of multiple falls received the monitoring and supervision identified in the care plan. The resident’s quarterly MDS showed a BIMS score of 4, indicating severe cognitive impairment, and documented 2 or more falls with no evidence of injury. Her care plan identified poor balance, poor communication/comprehension, unsteady gait, and lack of safety awareness, and included interventions such as frequent checks, keeping the call light within reach, moving her room close to the nurse’s station, and keeping the door open so staff could monitor her safety. The resident had multiple unwitnessed falls documented in the care plan, including a fall that resulted in a left hip fracture and hospitalization, followed by additional unwitnessed falls in her bedroom with no injury. The record also noted that she did not remember to use the call light, had hallucinations and delusions, and was being checked frequently for safety and reorientation. On the night of the incident, the resident was later found with bruising and swelling to her forehead, and the resident’s RP reviewed camera footage showing that she had fallen at 3:46 a.m. and did not report it to staff. Interviews and record review showed that CNA A did not go into the resident’s room throughout the night as expected, despite being responsible for checking residents every 2 hours. The ADM stated the CNA had not been in the room all night, while the DON stated the resident should have been checked every hour because she was a fall risk. LVN B stated she checked on the resident several times that night, but was not aware the CNA had not entered the room. The resident stated she did not use her call light or walker when she fell and that staff found her on the floor. The facility policy defined neglect as failure to provide goods and services necessary to avoid physical harm, pain, mental anguish, or emotional distress.
