The administrator stated the postings were covered by a white sheet of paper and did not violate HIPAA because room numbers were not visible. Surveyors later observed a Shower Log Binder on the counter at the nurses’ station while the station was unattended. Inside the binder was a Shower Sheet for one resident and an EBP List for 14 residents that included names, room numbers, and the reason each resident was on EBP. The ADON and DON stated the EBP List should not have been inside the Shower Log, and the DON stated the Shower Log should not be placed on the counter at the nurses’ station where it could be accessed by visitors. The administrator also stated she did not know the EBP List was included in the Shower Log. Record review showed the facility had a policy requiring resident-identifiable information to be protected and not left in open areas where unauthorized persons could access it, and that paper notes or reminders with resident personal or medical information should not be left unattended or viewable by unauthorized persons. Review of in-service records from 02/01/26 to 05/04/26 showed no in-service trainings on resident privacy during that period. The facility’s Resident Rights policy did not address HIPAA, PHI, or safeguarding electronic records, and the staff interviews reflected that the Thickened Liquid List, Red Napkin Program list, Shower Log Binder, and EBP List were all accessible in common or unattended areas.

The DON, Scheduler, Nurse, and Administrator all confirmed that video recording or taking pictures of residents was not allowed in the facility and that the recording occurred during resident care in the room. The report also states the GCA had received orientation training on protecting patient privacy and HIPAA.

The social worker documented that transfer referrals were sent to area nursing facilities as per the resident’s wishes. During interview, the family representative stated the resident and family had not requested referrals to other facilities and had already been arranging placement at a memory care facility, waiting for that facility’s room to be remodeled. The family representative also stated they were told the resident could not stay at the facility and that no discharge notice was given. Facility interviews showed the admission and discharge process was discussed at admission and during the 72-hour care plan meeting. The administrator, ADON, MDS coordinator, operations manager, and social worker stated the team discussed discharge planning, alternate placement, and that the resident wanted to move. The social worker stated he used nurses to translate and confirmed through nursing notes that the resident wanted to move, while also stating he doubted the resident had dementia because of the BIMS score. The POA stated she did not ask for referrals to be sent to other facilities and did not believe it was right that the resident’s information had been shared without permission. The facility’s discharge planning policy stated the discharge process should involve the resident and representative and document relevant resident information in the clinical record.
