Improper discharge and refusal to readmit a resident after behavioral transfer

Summary

The facility failed to permit a resident to remain in the facility and did not allow the resident to return after the resident was denied admission by an acute care facility. The resident was a male with diagnoses including anoxic brain injury, type 2 diabetes, critical illness myopathy, intermittent explosive disorder, dysphagia, ADHD, generalized anxiety disorder, muscle wasting and atrophy, and cognitive communication deficit. His quarterly MDS showed a BIMS of 07, indicating severe cognitive impairment, and he required substantial to maximal assistance with many ADLs and mobility tasks. The resident’s care plan identified physically aggressive and combative behavior related to poor impulse control, including an altercation with another resident after food was taken from him. Progress notes documented screaming, cursing at nurses and other residents, punching walls, continued one-to-one supervision, and an incident in which he struck another resident with a door. The facility documented that it contacted law enforcement and multiple hospitals for psychiatric placement, and that several hospitals declined to admit him. A transfer/discharge form was completed indicating an immediate transfer/discharge for behavioral symptoms and that the resident was discharged to a psychiatric hospital or unit with return not anticipated. After the resident was sent out, facility staff stated they were unsure whether he could return and later stated he would not be readmitted because of safety concerns and because the facility did not have a medical director with admitting privileges able to accept him. The SW stated she was unsure if the resident could return, while the ADON acknowledged that it was a resident right to return after discharge. The DON and ADM stated the resident was not going to be admitted back, and the MD stated he would not readmit him if the hospital called to discharge him. The report also states the facility did not provide a discharge or transfer policy during the survey and that the resident was later found at a homeless shelter after the behavioral hospital did not admit him.
