Summary

The facility failed to protect a resident from physical abuse by another resident when one resident struck another resident on the head with a metal cane. The injured resident had diagnoses including cerebral infarction, vascular dementia, and depression, and had a BIMS score of 10 on the most recent MDS, indicating moderate cognitive impairment. The other resident also had dementia and a BIMS score of 10. On 4/6/26, a CNA observed the resident with the cane standing outside the injured resident’s room with the cane raised in the air and separated the two residents. The CNA did not see the actual strike, but later noted blood coming from the back of the injured resident’s head. The injured resident stated that the other resident entered his room, struck him on the head with a metal cane, caused pain, and led to a hospital transfer for treatment. Nursing documentation described a cut to the right back of the head with two staples intact and noted the injury resulted from a resident-to-resident altercation. A licensed nurse stated she observed bleeding from the resident’s head and identified a 3-cm laceration to the back of the head, with transfer to the hospital for further evaluation and treatment. Care plans for both residents referenced the altercation and noted the resident with the injury would have no further incidents and no psychological effects from the altercation.
