Incomplete investigation of neglect, missing property, and unexplained injury
Summary
The facility did not ensure allegations of neglect, misappropriation of property, and injury of unknown origin were thoroughly investigated for three sampled residents. The facility policy required immediate investigation of suspected abuse, neglect, exploitation, misappropriation, and injuries of unknown source, including interviewing all involved persons, witnesses, and others with knowledge of the allegations, and documenting the investigation completely and thoroughly. For one resident, nurses’ notes documented family complaints about care concerns, including allegations that the resident was not being cleaned after an incontinent episode and that photos had been sent. The notes also documented family members entering the facility, confronting staff, and leaving after about 15 minutes. Facility leadership stated they were not aware of any care concerns and did not provide evidence of a further investigation into these allegations. The agency nurse later stated the family had grievances with the facility and that the resident’s family member was upset about the resident’s care, but no thorough investigation was documented. For another resident, who was cognitively intact and later discharged, the resident reported missing a wallet containing $1000. The facility investigated by interviewing the resident, the roommate, some staff, and searching the room, but the investigation did not include housekeeping or activities staff who worked on the unit during the relevant time period. The facility also did not document interviews with other residents, despite staff stating that resident interviews would normally be part of the process. The investigation was therefore incomplete based on the records reviewed. For the third resident, who had returned from an outside eye appointment with a bruise and raised, painful discoloration on the left shin, staff documented that the resident stated a transport driver placed a portable oxygen tank on the resident’s leg. The facility noted the injury and notified administration, but the record did not show a thorough investigation. Statements were not obtained from facility staff who were with the resident before and after transport, and the facility did not document resident interviews or statements from other residents who used the same transport company. The transport company later provided statements that differed from the facility’s account, and the facility record did not show a complete investigation into the injury of unknown origin.
