Summary

The facility did not ensure an allegation of abuse was reported to the NHA or designee for one resident. The facility’s Abuse, Neglect and Exploitation policy stated verbal abuse includes disparaging or derogatory communication toward residents and required reporting of alleged violations to the Administrator and other required agencies within specified timeframes. On 6/11/26, CNA-C observed CNA-E get down in the resident’s face and call the resident a motherfucker during an incident in the resident’s room, but the allegation was not reported to NHA-A. CNA-C also stated they did not report the incident to the nurse on duty or management. The resident had diagnoses including neurocognitive disorder with Lewy bodies, vascular dementia with anxiety, and traumatic brain injury. The resident’s MDS indicated the BIMS could not be completed, and the care plan showed the resident required staff assistance with ADLs. A progress note documented the resident was combative during cares, hit and tried to kick staff, and then remained in bed and slept for the rest of the shift. CNA-C reported the resident was combative during cares, hit CNA-E, and later said staff were forcing the resident to get up and broke the resident’s watch. Surveyor interviews and observations showed the resident had scratches on the left wrist and a yellow bruise on the stomach, and the resident’s watch was broken and later seen on the nightstand. RN-F knew the watch was broken and that the resident had been combative, but was not aware of the allegation of abuse or the scratches and bruise. CNA-D and CNA-E both confirmed the resident was combative during cares, but denied verbal or physical abuse toward the resident. ADON-H stated staff did not report abuse toward the resident, and NHA-A stated they had not received any reports of abuse from the resident or staff.
