Summary

The facility failed to provide adequate supervision to prevent an accident involving two residents in the memory care unit. One resident had diagnoses including unspecified dementia with behavioral disturbance, COPD, muscle weakness, and major depressive disorder, and his quarterly MDS coded a BIMS score of 3 out of 15, indicating severely impaired cognitive abilities for daily decision making. He was documented as being on constant supervision and later on 1:1 supervision because of aggressive behavior and a history of resident-to-resident altercations. On the day of the incident, staff documented that a resident-to-resident altercation occurred at about 3:40 PM. Nursing notes stated that a noise was heard, a chair flipped over, and a resident was found on the floor sitting in the hallway. The notes further stated that the aggressive resident picked up a chair and directed it toward the resident on the floor. The resident on the floor was brought to the nurses’ station for evaluation, and the physician, family representative, unit manager, DON, and Administrator were notified. The resident who was pushed was later sent to the hospital for further evaluation and CT scan, and the ED record noted a head injury. Interviews and video review showed that the assigned 1:1 staff member did not intervene quickly enough. An LPN stated that the 1:1 aide was watching and should have intervened sooner. The DON stated the staff member should have intervened much quicker. The Leadership Development Manager reviewed video showing the aggressive resident standing in front of the other resident and pushing him out of the chair onto the floor, while another staff member observed the incident and did not intervene until after the fall. The video also showed the aggressive resident attempting to strike the resident with a chair while the other staff member stopped the chair only after the attempt had begun. The 1:1 aide stated she did not think it would become physical and did not know what the constant observation was for.
