Failure to Implement Legionella Water Management and PPE Practices

Barre Gardens Nursing And Rehab, LlcBarre, Vermont Survey Completed on 06-17-2026

Summary

The facility failed to follow, maintain, and implement its Legionella Water Management Plan and failed to implement personal protective equipment when required. During interview, the Maintenance Director was unable to provide evidence of measures in place to prevent Legionella growth or explain what water safety standards the facility was following, and stated he disagreed with the plan and had thrown it away. The Infection Preventionist and DON also could not identify what water safety standards were being followed, and the Administrator was unable to provide evidence that the measures and monitoring described in the plan were being implemented, other than the plans for the eye wash station and ice machine. Review of the Legionella Water Management Plan and related policy identified dead legs, water storage temperature concerns, unused fixtures and eyewash stations to be flushed, visible dead-end lines to be documented, and standardized logs for cleaning, chlorine levels, and sanitation. The plan also stated that hot water should reach at least 140 degrees Fahrenheit and that Legionella thrives between 77 and 122 degrees Fahrenheit. The facility policy identified the water management team as including the Infection Preventionist, Administrator, Medical Director or designee, Director of Maintenance, and Director of Environment Services. In the laundry area, multiple washed Hoyer sling pads were observed drying on top of each other, and cleaned mop heads were drying in the dirty clothing/linen processing section. A laundry staff member stated she wore gloves when handling dirty linen and typically did not wear a gown, even though she acknowledged that soiled linen could not always be identified until it was already being handled. The Infection Preventionist and DON confirmed that wet Hoyer slings drying on other wet Hoyer slings was an infection control concern, and the CDC laundry guidance posted by the facility stated that laundry workers should wear appropriate PPE while sorting soiled fabrics and textiles. For Resident #10, who was on Enhanced Barrier Precautions for an indwelling catheter and nephrostomy tube, a nurse entered the room without hand hygiene, moved the catheter bag from the floor, and hooked it onto the bed without the appropriate PPE.

Failure to Use EBP PPE During Wound Care
D
F0880 F880: Provide and implement an infection prevention and control program.
Short Summary

Failure to Use EBP PPE During Wound Care: A resident with a wound and severely impaired cognition was receiving ordered wound care when the DON and ADON entered the room, washed hands, and donned gloves but did not wear gowns before starting care. EBP signage and PPE were present at the bedside, and both leaders later stated they forgot to put on gowns even though the resident was on EBP for an open wound and the facility policy required gown and glove use for wound care.

Failure to Follow Enhanced Barrier Precautions and Hand Hygiene During Resident Care
D
F0880 F880: Provide and implement an infection prevention and control program.
Short Summary

Staff failed to consistently follow EBP and hand hygiene for two residents who required high-contact care. One resident with an indwelling catheter and cognitive impairment did not have EBP followed during transfers, clothing removal, and pericare, and another resident with a suprapubic catheter and multiple pressure ulcers had staff wear PPE incorrectly, remove PPE in the room without hand hygiene, and continue care after emptying the catheter bag without changing gloves or cleaning hands. Interviews confirmed staff were expected to use gowns, gloves, and hand hygiene for these tasks.

E
F0880 F880: Provide and implement an infection prevention and control program.
Short Summary

A facility failed to maintain infection control during care for two residents. During incontinence care, a CNA removed gloves and applied clean gloves without hand hygiene before placing a clean brief on a resident who was dependent for toileting hygiene and always incontinent. During ostomy care, an LVN handled a resident’s colostomy, wiped stool from the stoma, and continued care without removing soiled gloves, sanitizing hands, or putting on clean gloves. The DON stated staff were expected to perform hand hygiene between glove changes.

D
F0880 F880: Provide and implement an infection prevention and control program.
Short Summary

Infection Control Failures During Incontinent Care: Two residents were observed receiving incontinent care with multiple infection control lapses. A CNA did not perform hand hygiene between glove changes or after glove removal while caring for one resident, and another CNA did not wash hands before care, changed nothing between dirty and clean tasks, touched clean items with dirty gloves, placed soiled linens on the floor, and handled dirty linens with bare hands after glove removal. The DON stated hand hygiene, glove changes, and proper handling of soiled linens were required, and facility policies reflected those practices.
