Summary

The facility failed to provide the necessary care and services to ensure that Resident #39’s abilities in activities of daily living did not diminish based on the comprehensive assessment and consistent with her needs and choices. Resident #39 was a female admitted with Parkinson’s disease, and her significant change in status MDS assessment reflected that her preferred language was Spanish and that she needed or wanted an interpreter to communicate with a doctor or health care staff. The assessment also reflected that she made herself understood and usually understood others, with a BIMS score of 7 indicating severely impaired cognition. Resident #39’s care plan identified a communication problem related to the language barrier and listed interventions to anticipate and meet needs and provide a translator as necessary. The record also reflected that she spoke in a non-dominant language. During observation, the surveyor spoke to Resident #39 in English, but she did not respond, and her family member stated that she did not speak English. No communication board was observed in her room. During interviews, the family member stated Resident #39 preferred Spanish and that staff had previously called her multiple times during the night to translate, and that a Spanish list she had printed and given to a CNA was not seen in the room. CNA M stated Resident #39 understood very little English and that she had raised the need for a translator or Spanish communication board to the Administrator and charge nurse, but was told to use staff who could speak Spanish. RN A and the DON both stated Resident #39’s primary language was Spanish and that effective communication was important to ensure her needs were met. The Administrator stated she had told staff to utilize Spanish-speaking staff and was not sure whether staff knew a translator was available.
